Mr.Nawal Kishore Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 12-03-2026 Heard Ms. Rashmi Jha, learned counsel appearing on behalf of the petitioners and Mr. Nawal Kishore Prasad, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Simri Bakhtiarpur P.S. Case No. 256/2025 registered for the offence(s) punishable under Sections 64(1), 3(5) of the BNS.
3. As per the allegation made in the FIR, the informant Kumari Indira has alleged that the co-accused Krishna Kumar sexually exploited her for about two years on the false promise of marriage and subsequently refused to marry her despite repeated assurances made before villagers and local
Patna High Court CR. MISC. No.10599 of 2026(2) dt.12-03-2026 2/3 persons, and thereafter arranged his marriage with another woman, thereby deceiving the informant.

Learned counsel appearing on behalf of the petitioners submitted that petitioners, who are the parents of coaccused Krishna Kumar, are innocent and have been falsely implicated in the present case. The said Krishna Kumar has been enlarged on pre-arrest bail by this Court vide order dated 24.02.2026 passed in Cr. Misc. No.5975 of 2026. A general and omnibus allegations has been levelled against the petitioners due to village politics. The allegations primarily related to the alleged relationship between the informant and the co-accused Krishna Kumar (son of the petitioners), in which the petitioners had no role. The petitioners have clean antecedent. On these grounds the petitioners seek to be released on pre-arrest bail.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Having considered the rival submissions made on behalf of the parties, as well, having perused the allegations made in the FIR, it appears that the petitioners, who are the parents of the co-accused Krishna Kumar, have been implicated in the present case. The said co-accused Krishna Kumar has already been enlarged on pre-arrest bail by this Court vide order
Patna High Court CR. MISC. No.10599 of 2026(2) dt.12-03-2026 3/3 dated 24.02.2026 passed in Cr. Misc. No. 5975 of 2026. Considering that the petitioners have clean antecedents, they, prima facie, have made out a case for being released on prearrest bail.

The petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District Court where the case is pending / Concerned Court in connection with Simri Bakhtiarpur P.S. Case No. 256/2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
8. The learned District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases, as what has been stated in paragraph no.3 of the bail application, this order will automatically lose its force.
