JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-05-2022 In pursuance to the previous orders passed by this Court dated 23.2.2022 and 27.04. 2022, two show cause have been filed stating therein that the order dated 22.7.2021 passed by this Court in CWJC No. 7901 of 2020 has stood complied with. The learned Senior counsel for the petitioner, Shri Y.V. Giri, assisted by Shri Sanjay Kumar Giri, Advocate has submitted by

Patna High Court MJC No.159 of 2022(4) dt.05-05-2022 2/2 referring to the show cause filed today that it appears that almost all the outstanding dues to be paid to the widow petitioner have been paid except the balance amount of 10% pension/ family pension and gratuity.

On a query made to the learned counsel for the contemnors Shri Nadim Seraj, Advocate, regarding non-payment of 10% of the pension/ family pension and 10% of the gratuity amount, he submits that though he has got no instructions but it may be possible that since final pension/ family pension and the gratuity payment order is yet to be issued by the office of the Account General, Bihar, Patna, provisional 90% amount been paid at the moment since the contemnors were in a hurry to comply with the orders of this Court before today's date of hearing. In such view of the matter, I deem it fit and proper to dispose of the instant contempt petition, however, with a direction to the contemnors to ensure payment of the balance amount of pension/ family pension and gratuity to the widow petitioner within a period of six weeks from today, failing which the petitioner would be at liberty to file appropriate interlocutory application for revival of the present petition.
