2. Petitioner in this case had applied for appointment on the post of Panchayat Teacher in Raj South Bhandartal under Barari Block of Katihar district against
Patna High Court CWJC No.2189 of 2023(2) dt.31-07-2023 2/3 the post reserved for MBC-I category during the appointment process undertaken in the year 2006. It is his case that that he was the most suitable candidate in MBC (Annexure '1') category but he became shocked and surprised on knowing that six seats are available but his claim had been ignored and one Md. Nisar Alam has been appointed in R.H.K. High School Jotramrai, Barari (Katihar). He claims that since then, the seat is lying vacant.
3. On perusal of the impugned order passed by the learned State Appellate Authority, this Court finds itself in agreement with the reasoning and rationale provided in the impugned order. The 2006 appointment process came to an end in the year 2007 itself and all the panels and waiting list expired. Hence, the Tribunal has rightly concluded that no appointment can be made from an expired panel or waiting list. The vacancy which came into existence in 2020 has to be filled up in the next appointment process according to the rules which apply to the next process.
4. This Court finds that it is in the nature of a frivolous writ application. It is being dismissed with a cost of Rs. 5,000/- (Rupees Five Thousand only) which will be
