The petitioner seeks regular bail in connection with Raniganj P.S. Case No. 394 of 2017 for the offences punishable under Sections 147, 148, 341, 342, 307, 384, 506, 504 of the Indian Penal Code and Sections 3⁄4 of the Prevention of Witch Hunting Act.
The allegation is that sister-in-law of the informant was living with him so villagers protested and in the night they assaulted the wife of the informant, with various arms and hot iron rod, after removing her clothes.
It is submitted that general and omnibus allegation has been made against all the accused persons, hence the petitioner cannot be singled out, especially since the petitioner is 60 years old
Patna High Court Cr.Misc. No.10902 of 2019(2) dt.25-02-2019 2/2 and is not expected to commit such crime. It is further submitted that similarly situated other accused persons have already been granted bail vide order dated 13.04.2018 passed by a coordinate Bench of this Court in Cr. Misc. No. 6885 of 2018. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 18.05.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Raniganj P.S. Case No. 394 of 2017.
