Petitioner is not named in the F.I.R. but admittedly petitioner was made accused in Dariyapur P.S.Case No. 06 of 2011 in which the son of present informant was killed. The deceased of the present case was witness in the aforesaid Dariyapur P.S.Case No. 06 of 2011 and it is stated that one Tarun Rai, who was also accused in Dariyapur P.S.Case No. 06 of 2011 hatched conspiracy along with F.I.R named accused Ganesh Rai and one unknown for committing the murder of the deceased of that case. Moreover, the alleged occurrence took place in the year 2010 but it appears from perusal of the impugned order that petitioner has been made accused in the present case on the basis

Patna High Court Cr.Misc. No.37828 of 2015 (2) dt.04-09-2015 2/2 of supervision note of Superintendent of police who directed the I.O to submit charge sheet against all those persons who were accused in Dariyapur P.S.Case No. 06 of 2011. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge cum Special Judge SC/ST ( POA) Saran at Chapra in connection with Dariyapur P.S.case No. 185 of 2012.
