NILU AGRAWAL ORAL ORDER 31-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 02.04.2015 in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code. The prosecution case is that on 28.10.2013 at 8.30 P.M. the informant was sitting in front of her house. Her husband was also walking having taken meal near shop of Deepak Mobile Plaza. In the meantime while colour Scorpio rashly came therein order to kill him. Her husband was attempted to be snatched, he raised alarm. In this course, her husband fell down on the road. The vehicle in question came back and again dashed her husband and fled away towards west. The light of the vehicle was put-off.

After two hours the informant came to know that white coloured Scorpio bearing Registration No. BR09M-4228 is standing abandoned near house of Bangali Mahton at Bardaha with blood stain. It has been submitted by the learned counsel for the petitioner that the petitioner is not named in the F.I.R. and on the basis of confessional statement of one of the co-accused Mahesh Das, his name has been surfaced. Since confessional statement of the co-accused has no evidentiary value, under such circumstances, let the petitioner Ram Narayan Sah @ Panchu Munshi be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in Khondawanpur P.S.Case No. 226/2013 subject to the following conditions:- i) One of the bailors will be the close relative of the petitioner.

ii) The petitioner will not indulge in similar or in any other offence.

iii) The petitioner will be well represented in the Court.

iv) In case of absence for two consecutive dates
