The petitioner apprehends his arrest in Complaint Case No.707 of 2017 registered under Section 498A of the Indian Penal Code and under Section 4 of Dowry Prohibition Act.
The learned counsel for the petitioner submits that petitioner is ready to keep his wife. On the date fixed for hearing the bail petition, the petitioner could not reach the Court as the petitioner was working in Punjab. The learned counsel for the petitioner submits that on account of this, anticipatory bail petition of the petitioner was dismissed as not pressed. Since the petitioner is ready to keep his wife, the
Patna High Court Cr.Misc. No.6129 of 2019(2) dt.04-02-2019 2/2 petitioner, above named, is directed to surrender before the court below within a period of four weeks from the date of receipt of the order, on such, learned court below shall enlarge the petitioner on provisional bail for three months on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Madhepura in connection with Complaint Case No.707 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Thereafter, the court below shall make efforts for resolution of the disputes between husband and wife. If the petitioner keeps his wife properly, learned court below shall confirm the provisional bail of the petitioner and if the petitioner fails to keep his wife properly, the learned court below shall pass order on the provisional bail of the petitioner immediately after three months in accordance with law.
