JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 31-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 420, 468 and 483 of the Indian Penal Code.
It is a case of recovery of two motorcycles bearing same registration no.BR-2IN-6953 which were parked in front of the house of the petitioner and these are stolen. Learned counsel or the petitioner submits that petitioner has falsely been implicated in this case and the petitioner has no concern with the seized motorcycles. However, learned APP for the State opposes the anticipatory bail of the petitioner.
After considering the facts and circumstances of the
Patna High Court CR. MISC. No.6933 of 2022(3) dt.31-08-2022 2/2 case as well as the fact that two motorcycles were recovered in front of the house of this petitioner, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is rejected.
However, the petitioner is directed to surrender before the court below and pray for regular bail.
