Mr.Md. Matloob Rab ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks bail in connection with Kotwali P.S. Case No.894/2019, registered under Sections 399, 401, 402, 413, 414, 120B of the Indian Penal Code and later on Sections 25 (1-b)a, 26, 35 of Arms Act were added.

The petitioner along with other accused persons were apprehended while planning to commit dacoity with large number of arms and ammunitions.

Submission of learned counsel for the petitioner is that the petitioner is innocent and has not committed any offence. No incriminating articles were recovered from his possession Further, the petitioner has no criminal antecedent and the co-accused persons have already been enlarged on bail which will appear Annexure-2 series by this court. Petitioner is in custody since 06.10.2019.

In view of the above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna, in connection with Kotwali P.S. Case No.894/2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
