JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-01-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioners undertakes to remove the defects as pointed out by the office, within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, the office will place the matter before the Bench. The petitioner apprehends his arrest in a case in connection with Laukaha (Lalmania) P.S. Case No.125 of 2020 (G.R. No.652/2020), registered for the offence punishable under Sections 341, 323, 307, 379, 504 & 506/34 of the IPC.
The allegation against the petitioner is that he along with other accused persons has assaulted the informant by
Patna High Court CR. MISC. No.19969 of 2021(2) dt.13-01-2022 2/3 means of lathi-danda due to which the informant got bleeding injury.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to land dispute. No such occurrence as alleged has ever taken place. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. There is a case and counter case between the parties for the said occurrence and both sides have sustained injuries. In fact the present case is the counter blast of Laukaha (Lalmania) P.S. Case No.124 of 2020 lodged by the petitioner against the informant and his family. Petitioner has one criminal antecedent, as mentioned in para-3 of the anticipatory bail application. Learned APP for the State opposed the prayer for bail.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.
