2. The petitioners seek bail in connection with Beldour P.S. Case No. 234 of 2023 registered for the offence under Sections 25(1-B)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, one country made pistol and eight live cartridges have been recovered from the possession of the petitioners.

4. Learned counsel for the petitioners submit that the the petitioners are innocent and they are falsely implicated in this case.

5. It is also submitted by the learned counsel for

Patna High Court CR. MISC. No.8397 of 2024(2) dt.22-02-2024 2/2 the petitioners that the petitioners have no criminal antecedent and they are in jail since 30.08.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Beldour P.S. Case No. 234 of 2023.

9. As a condition of this order, petitioner no. 1 is directed to mark his attendance at Puraini Police Station and petitioner no. 2 is directed to mark his attendance at Chausa Police Station on first Sunday of the each month. Any default in appearance at the police station will result in cancellation of bail bond of the petitioners.
