JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with accusation that he was caught red handed while committing theft of electric wire and 200 kg. electric wire were recovered from the pickup van of the petitioner.

The contention on behalf of the petitioner is that petitioner is owner of the pickup van and as a matter of fact hot exchange of words had taken place between the petitioner and informant on the point of payment of fare of aforesaid pickup van and that is the reason, the informant implicated the petitioner in the alleged crime. It is further contended by him that petitioner is in jail custody since 04.07.2015.

No.36987 of 2015 (2) dt.02-09-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Dumraon (N.B.) P.S. Case No. 212 of 2015.
