====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Rahui P.S. Case No. 97 of 2018 (G.R. No. 1001/18) for the offenses under Sections 147, 149, 323, 504, 506, 307 and 324 of the Indian Penal Code and 27 of the Arms Act. The petitioner is in custody since 04.05.2018.

Earlier the prayers for bail of the petitioner were rejected by this Court in Cr.Misc.No. 42480 of 2018 vide order dated 26.09.2018 as well as in Cr.Misc.No. 28356 of 2019 vide order dated 19.06.2019. While rejecting the prayer for bail in Cr.Misc.No. 28356 of 2019 on 19.06.2019, liberty was granted to the petitioner to renew his application for bail after six months. The petitioner has approached this Court after six

Considering the liberty granted by this Court to the petitioner to renew his bail application on 19.06.2019, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Nalanda, Biharsharif, in connection with Rahui P.S. Case No. 97 of 2018. The court below is directed to expedite the trial on day to day basis so as to conclude the same within a period of six months. However, it is made clear that if the petitioner adopts any deviating tactics and fail to attend for two consecutive days for trial before the court below without any cogent reason, the court below shall be at liberty to cancel his bail bonds in the present case.
