2. The petitioner seeks bail in connection with Bihariganj P.S. Case No. 118 of 2020, registered for the offence punishable under Sections 447, 341, 323, 324, 325, 307, 302, 379, 504, 506/34 of the Indian Penal Code.

3. This is the third attempt of the petitioner for grant of regular bail. Earlier the bail was rejected twice by this Court vide order dated 04.10.2021 passed in Cr. Misc. No. 13477 of 2021 and vide order dated 17.05.2023 passed in Cr. Misc. No. 26405 of 2023, with a direction to the trial court to conclude the trial within stipulated period.

4. Vide order dated 09.02.2024, a report was called for, regarding the stage of trial. In compliance thereof, a report

No.8298 of 2024(3) dt.13-03-2024 2/2 sent by learned Additional District & Sessions Judge-V-cumSpecial Judge, Excise-I, Madhepura, dated 13.02.2024, is kept in flag 'A', whereby it is stated that at present the case is going on for defence evidence. The next date is fixed on 15.02.2024 for defence evidence.

5. Considering the submissions made in the report, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is hereby rejected.

6. However, the petitioner is directed to co-operate in the trial and produce the defence evidence.
