Petitioner seeks bail in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner and co-accused Priyesh Sahni @ Prince Kumar took the husband of the informant from his house and in the next morning the dead body of the husband of the informant was found. The informant suspects that petitioner and Priyesh Sahni @ Prince Kumar might have committed murder of her husband for some dispute relating to distribution of money or any other dispute.

Submission is that there is no eye witness of the occurrence. Only suspicion is there and the petitioner was arrested by the police and confessional statement was recorded.

Patna High Court CR. MISC. No.8994 of 2019(3) dt.30-04-2019 2/2 Priyesh Sahni @ Prince Kumar has allowed bail by a CoOrdinate Bench of this Court. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khanpur Police Station Case No. 104 of 2018, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
