JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is wife of the deceased. The deceased died at the house of his in-laws. After death of the deceased, the brother of deceased lodged U.D case disclosing this fact that deceased died of heart attack but subsequently after post-mortem examination of the dead body of the deceased, it was detected that cause of death of the deceased was poisoned. Furthermore, it also came to light that petitioner had illicit relation with co-accused Mukesh Singh @ Mukesh Kumar Singh who has already been granted privilege of bail by this Court. No doubt the alleged occurrence took place in the year 2008 but it appears that investigation against the petitioner was kept pending because he
Patna High Court Cr.Misc. No.37829 of 2015 (2) dt.04-09-2015 2/2 was absconder.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Purnea in connection with K.Nagar P.S.Case No. 228 of 2008.
