JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-04-2023 The present writ petition has been filed seeking the following relief :- " (i) For issuance of a writ in the nature of 'Mandamus' whereby and where under commanding and directing State respondents to execute the order dated- 8.1.2016 passed in Gram Panchayat Execution case No.

1/2013 by the learned Munsif-II, DistrictBhagalpur with regard to the landed properties appertaining to Khata no. 161 corresponding Khesra no. 555, 585 measuring an area of 4 decimal of ScheduleA of the plaint and Khata No. 309 corresponding to Khesra no. 603, 592, 601 and 607 measuring total area of land 1 Acre 2 decimal of Schedule -B of the plaint situated in Mauza Raghopur, Thana No.8, P.S- Nathnagar, District- Bhagalpur, which is the Khatiyani land of the petitioner and over the same the private respondents have illegally taken into their physical possession and erected temporary structures over the same and resisting the police force to remove the encroachment from the aforesaid land.

Ex- 01/2013 by the learned Munsif -II, Bhagalpur and apart from that to give the petitioner suitable compensation of the loss that he has incurred due to non- execution of the order dated8.1.2016 passed in G.P. Ex- 01/2013 at Bhagalpur."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition. Accordingly, the present writ petition stands dismissed as not pressed.
