2. The petitioner seeks bail in connection with Bochahan P.S. Case No. 69 of 2024 instituted for the offences punishable under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code.

3. Earlier the prayer for anticipatory bail of this petitioner has already been withdrawn by this Court in Cr. Misc. No. 64004 of 2024 vide order dated 20.11.2024.

4. Allegation against the petitioner and other coaccused persons is to have inflicted by knife blow on the left side of the abdomen of the informant and also assaulted by fists and slaps due to which the informant sustained grievous injury.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.6117 of 2025(5) dt.11-07-2025 2/3 case. He further submits that all the offences are bailable in nature except Section 307 of the Indian Penal Code and there is no any injury report as mentioned in the impugned order. Petitioner is in custody since 17.11.2024.

6. Learned APP for the State opposes the prayer for bail of the petitioner.

From perusal of the FIR, case diary, injury report and impugned order of the learned Additional Sessions Judge1st, Muzaffarpur dated 21.12.2024, it appears that petitioner is named in the FIR and the informant, namely Umesh Prasad Sahu has registered an FIR under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code against five accused persons including the present petitioner. All the accused persons assaulted by means of knife, which hit upon the abdomen of the informant. The specific allegation against the petitioner is of only firearms. From perusal of paragraph no. 21 of the case diary, it appears that the informant-cum-injured was referred to SKMCH on 21.03.2024 for diagnosis of stab injury and again for better treatment he was referred to AIIMS, Patna and during course of treatment, the informant-cum-injured has sustained one stitched injury found on his body which is simple in nature. Petitioner is in custody since 17.11.2024, so considering all

8. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 14th Court, Muzaffarpur in connection with Bochahan P.S. Case No. 69 of 2024.
