The present writ petition has been filed seeking the following relief:- "(i) That by way of this writ application petitioner seeks indulgence of this Hon'ble Court for issuance of appropriate writ/ order direction in the nature of mandamus commanding the respondents to make payment of remaining compensation amount to the tune of Rs. 2,00,000/- (Two Lakhs) to the petitioner on account of sever acid injury inflicted by the accused person on 24-10-2014."

At the outset, the learned counsel for the respondent-State has submitted by referring to the counter affidavit, filed in the present case that the case of the petitioner

Patna High Court CWJC No.14770 of 2017 dt.27-06-2023 2/3 was considered by the Criminal Injuries Compensation Board on 15.12.2015, whereupon the Board has recommended for payment of a sum of Rs.1,00,000/- to the petitioner and thereafter, the said amount has also been paid to him. It is also submitted that in case the petitioner is aggrieved by the same, he can file an appeal before the Bihar State Legal Services Authority, under Clause 9 of the Bihar Victim Compensation Scheme, 2014.

The learned counsel for the petitioner has submitted that as per schedule-1 of the said Bihar Victim Compensation Scheme, 2014, the acid attack victims are required to be paid compensation @ of Rs.3,00,000/-, however, the Criminal Injuries Compensation Board has recommended compensation amount, only to the tune of Rs.1,00,000/-, hence the petitioner be granted liberty to file appropriate appeal before the Bihar State Legal Services Authority, Patna. 4.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with liberty to the petitioner to file appropriate appeal before the Bihar State Legal Services Authority and in case appropriate appeal is filed, within a period of four weeks from today, the appellate authority shall consider the same on merits,

Patna High Court CWJC No.14770 of 2017 dt.27-06-2023 3/3 without being impeded by the issue of limitation and pass a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
