The petitioner has preferred this application for grant of regular bail in connection with a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegations in the F.I.R, 170 litres of liquor was recovered from the car in question and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the person or car of the petitioner. He has been falsely implicated in the case. He is in custody since 28.11.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the petitioner having two antecedents under the Bihar Prohibition and Excise Act, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Liberty is granted to the petitioner to renew his prayer for bail after completing one year in custody.
