The petitioner seeks bail in anticipation of his arrest in connection with Bandeya P.S. Case No. 30 of 2018 instituted for the offences under Sections 135 of the Indian Electricity Act, 2003.

The petitioner is said to have caused losses to the State exchequer by an amount of Rs. 91,954/- for having misused the electric connection for irrigating his field. The learned counsel for the petitioner has submitted that such accusation is absolutely false and misdirected.

No.17259 of 2021(3) dt.22-03-2022 2/2 However, he is ready to deposit Rs. 30,000/- subject to his rights and contentions later before the court below, which would be adjusted against the amount which might be found to be due to the electricity department. Considering the afore-noted submission on behalf of the petitioner, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order upon depositing an amount of Rs. 30,000/- under protest and subject to his rights and contentions later before the court below as well as on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity), Magadh Area, Gaya as well in connection with Bandeya P.S.
