Petitioner apprehends his arrest in connection with Barachatti-Mohanpur P.S. Case No.1011/2022, registered for the offence punishable u/s 30(a) of Bihar Excise and Prohibition Act, 2018.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek

Patna High Court CR. MISC. No.10526 of 2023(2) dt.24-04-2023 2/2 regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that there is no recovery from the conscious physical possession of the petitioner and petitioner has no criminal antecedent.
