The petitioner apprehends his arrest in connection with Forbesganj P.S. Case No. 888 of 2021 registered under Sections 30(a) of Bihar Prohibition and Excise Act. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. There is general and omnibus allegation against the petitioner.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the first information report and he is having one more criminal antecedent of same nature. The father of the petitioner specifically stated that his son was indulged in

Patna High Court CR. MISC. No.6850 of 2022(2) dt.20-05-2022 2/2 the business of sale and purchase of illicit liquor, as is evident from the first information report. Hence, petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the opposite party, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected. (Arvind Srivastava, J) utkarsh/- U T
