JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, it came to light that petitioner happens to be husband of co-accused, Priyanka Devi, who had sweet relation with deceased and according to prosecution case, the deceased went to meet Priyanka Devi on her call and after that, his dead body was recovered. Furthermore, in course of investigation, some witnesses claimed that prior to alleged occurrence, petitioner and co-accused, Ramjapo Mahto had given threatening to family members of the deceased and paragraph-33 of the case diary reveals that the mobile, which has been used to call the deceased prior to his death, had been used by changing

Patna High Court Cr.Misc. No.36934 of 2015 (3) dt.04-11-2015 2/2 sim and except the aforesaid material, there appears to be nothing against the petitioner, who is languishing in jail custody since 2312-2014. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Naokothi P.S. Case No. 90 of 2014 to the satisfaction of Sri Rameshwar Mishra, learned Judicial Magistrate-Ist Class, Begusarai.
