Although petitioner is named in the first information report but it is stated that one day prior to the alleged occurrence petitioner and other F.I.R named accused had assaulted the informant and the deceased but admittedly, no case was lodged for the aforesaid occurrence. Subsequently, it is stated that on the alleged date of occurrence the deceased was taken away from his house by other accused persons and not by the petitioner.
