The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(d), 33 and 36 of the Bihar Prohibition and Excise Act, 2016. As per allegation in the FIR, on a raid being conducted 245 litres of spirit, large quantity of IMFL and packing machines etc. were recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or from his house and he has been falsely implicated in the case because of his one antecedent under the Bihar

Patna High Court CR. MISC. No.11870 of 2021(2) dt.30-07-2021 2/2 Prohibition and Excise Act, 2016. He is in custody since 6.10.2020.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the FIR and the antecedent of the petitioner, the Court is not inclined to enlarge the petitioner on bail and the same is rejected. Liberty is granted to the petitioner to renew his prayer for bail on completing one year in custody.
