2. The petitioner seeks bail in connection with Bihpur (Jhandapur) P.S. Case No. 511 of 2023 registered for the offence punishable under Sections 394, 412 of the Indian Penal Code.

3. This is the second attempt by the petitioner for bail. Earlier, this Court vide order dated 21.06.2024 in Cr. Misc. No. 29249 of 2024 had dismissed the bail of the petitioner.

3. As per the prosecution case, the petitioner is accused of looting one motorcycle, mobile, purse, tab etc.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that similarly situated co-accused has been granted bail by this Court vide order dated 22.11.2024 in Cr. Misc. No. 65031 of 2024. The petitioner is in jail since 25.09.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge, Naugachhia, Bhagalpur in connection with Bihpur (Jhandapur) P.S. Case No. 511 of 2023, subject to the following conditions:

(i) The petitioner, after being released on bail is directed to mark his attendance at Parbatta Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

(ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court.
