The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 399/402 of the Indian Penal Code and sections 25(1-b)A, 26 and 35 of the Arms Act.
As per the prosecution case, on secret information that some miscreants assembled and were making preparation to commit an offence, a raid was conducted. During that process, two persons were apprehended who disclosed name of this petitioner as one of their accomplices.
It is submitted that petitioner is not named in the FIR. Name of petitioner transpired in this case on the basis of confessional statement of co-accused Rohit Singh. No
Patna High Court CR. MISC. No.8127 of 2023(2) dt.11-05-2023 2/2 incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 132 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
