Learned counsel appearing on behalf of the petitioner submits that the issue raised in the present writ application is covered by the decision of the L.P.A. Court in L.P.A. No. 135 of 2008 dated 11.11.2008. He submits that in that case the writ petitioner Anjana Kumari appeared through the same College in the academic Session 1993-95,whereas this petitioner appeared in the intermediate examination in the academic Session 199193. He submits that the case of the petitioner of this case is squarely covered by the judgment of the Division Bench passed in L.P.A. No. 135 of 2008.
Considering the aforesaid, the writ application is
Patna High Court CWJC No.2775 of 2019(3) dt.02-08-2019 2/2 disposed of with a direction to the Bihar School Examination Board, Patna to examine the case of the petitioner in the light of the judgment of the Division Bench passed in L.P.A. No. 135 of 2008 dated 11.11.2008 and pass appropriate order in the light of the aforesaid judgment.
Necessary decision in this regard must be taken by the respondent Board within a maximum period of three months from the date of receipt/production of a copy of this order. With the aforesaid, the writ application stands disposed of.
