JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner along with two others was caught and one automatic pistol along with magazine containing five live cartridges was recovered from conscious possession of the petitioner. Petitioner does not have any criminal antecedent and having more or less similar allegation, co-accused, Alok Kumar Jha and Md. Gullu @ Gulab have already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.37127 of 2015 (3) dt.04-11-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 227 of 2015.
