The petitioner seeks bail in anticipation of his arrest in connection with Araria P.S. Case No. 502 of 2018 dated 30.07.2018 instituted for the offences under Sections 406, 409, 420 and 34 of the Indian Penal Code.

The allegation in the FIR, which has been lodged after eight years of the execution of the agreement is of use of substandard materials in the execution of the work, in derogation of the DPR. Several other accused persons have been granted the privilege of anticipatory bail by different benches of this Court, taking into account the delayed lodging of the FIR and general and omnibus nature of allegation. The petitioner

Considering the aforestated facts and taking into account that the petitioner is still in service and has clean antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 502 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
