JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Alauli P.S. Case No. 363/2017 registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code.
There is allegation of assault and theft against the petitioners but, admittedly, the case was registered under Sections 341, 323, 379, 504/34 of the Indian Penal Code and after investigation police submitted chargesheet for bailable offences but the learned Magistrate took cognizance for the offences under Section 379 as well as other bailable sections of
Patna High Court CR. MISC. No.4893 of 2020(2) dt.02-03-2020 2/2 the Indian Penal Code.
Learned counsel appearing for petitioners submits that the learned Magistrate has already issued warrant of arrest against the petitioners.
Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioners, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magisrate 1st Class, Khagaria/concerned court in Alauli P.S. Case No. 363/2017 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
