Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under section 30(a) of Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner has submitted that the alleged liquor was not recovered from possession of the petitioner rather it was recovered from the house of Bhola Paswan. He submitted further that the petitioner is accused in two other cases of similar nature but in the present case he is in custody since 29.11.2021.

No.6919 of 2022(2) dt.26-05-2022 2/2 Considering the facts and circumstances of the case, let the petitioner above named be released on bail only after framing of the charge on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II-cum- Special Judge, Excise Act, Sitamarhi in connection with Riga P.S. Case no. 43 of 2020. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
