24.08.2020 Heard Mr. Ashok Kumar Mishra, learned counsel for the petitioner and Mr. Ram Priya Sharan Singh, learned APP for the State.
The petitioner seeks bail in connection with Bidupur P. S. Case No. 334 of 2019, dated 24.08.2019, instituted for the offences under Sections 304 (B)/201 of the Indian Penal Code.
The petitioner is the father-in-law of the deceased.
It has been submitted on behalf of the petitioner that he has only been made accused in this case because of his being the father of the husband of the
deceased. There has been a delay of two months twenty days in filing the F.I.R. and the petitioner is in custody since 25.08.2019.
This Court has taken note of the fact that the husband of the deceased is in custody at present. Regard being had to the nature of accusation against the petitioner, which is general and omnibus and his period of custody, he is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur P. S. Case No. 334 of 2019.
However, it is made clear that the petitioner shall participate in the trial and his non-cooperation in the trial would render his bail liable to be cancelled. (Ashutosh Kumar, J) skm U T
