JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420,467,468 of the Indian Penal Code.

Prosecution case is that on a secret information raid was conducted and one Shrawan Kumar was apprehended with fake currency and a motorcycle. It is alleged that the said motorcycle is registered in the name of the petitioner. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only because he happens to be brother-in-law of said coaccused Shrawan Kumar. No incriminating material has been recovered from conscious possession of the petitioner or from the motorcycle of which petitioner is owner. Petitioner is no way connected with aforesaid recovery. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghatti Gaya in Barachatti Police Station Case No. 758 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
