2. This writ application has been preferred for setting aside the order dated 23.02.2017 passed in Case No. 534M/2016, a proceeding under Section 145 Cr.P.C whereby the learned Sub Divisional Magistrate, Raxaul has attached the land under proceeding in exercise of power under Section 146 Cr.P.C.

3. After hearing the parties, this Court is of the view that the Writ Court cannot enter into the examination of the correctness or otherwise of the impugned order and substitute its finding as appellate court. Hence the petitioner may move under appropriate jurisdiction.
