The petitioner seeks bail in Amas P.S. Case No.150 of 2019 registered for the offence punishable under Sections 8/20(b)(ii)(c)/29 of N.D.P.S. Act, 1985.

The allegation is of recovery of 120 Kg. Ganja from a Bolero Jeep having occupied by the driver Sonu Pal (the petitioner) and Dharmedra Yadav, which was being carried for the purpose of transportation.

Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case having no criminal antecedent and he is in custody since 02.08.2019. Further submission is that nothing has been recovered from the possession of the petitioner and he, being a driver, was driving the said vehicle on the wages and he had no knowledge about

Patna High Court CR. MISC. No.4799 of 2020(2) dt.29-01-2020 2/2 the said Ganja, kept in the vehicle. It is submitted that one of the co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 06.12.2019 passed in Cr.Misc.No.80163 of 2019.

Heard learned Addl. Public Prosecutor, who has opposed the prayer for bail of the petitioner on the ground that the name of the co-accused, who has been granted bail, had figured on the basis of confession, whereas the petitioner was arrested in the vehicle, while carrying Ganja. Be that as it may, considering the facts and circumstances, as stated above, I am not inclined to enlarge the petitioner on bail.

Accordingly, the petition for bail stands dmissed. (Vinod Kumar Sinha, J) nawalkrs/- U
