JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with Chautham P.S. Case No. 299 of 2019, registered for offences punishable under Sections 447, 341, 307, 504/34 of the Indian Penal Code and Section 25(1-b)a, 26, 27 and 35 of the Arms Act.
Allegation as per F.I.R. is that petitioner and other accused persons came variously armed to the field of informant and made indiscriminate firing and in course of chase, one of the accused was apprehended having pistol in his hand. Submission of learned counsel for the petitioners is that from the F.I.R. itself, it is evident that nobody has received injury. Further submission is that petitioner has falsely been implicated in this case due to land dispute between the parties
Patna High Court CR. MISC. No.5368 of 2020(2) dt.31-01-2020 2/2 and he has been judicial custody for about two months. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Khagaria, in connection with Chautham P.S. Case No. 299 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
