Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code. According to the prosecution case the allegation is that while the informant along with his wife and children were sleeping on a cot he saw them burning. On alarm many persons came there and put off fire.

Learned counsel for the petitioner submits that petitioner is daughter-in-law of the informant. There is no eye witness of the occurrence. The petitioner was also sleeping in the house just by the side of the cot of her mother-in-law and on mere suspicion name of the petitioner has come that petitioner might have ignited fire.

Patna High Court Cr.Misc. No.38320 of 2014 (3) dt.28-01-2015 2/2 Having considered the fact that petitioner was also sleeping by the side of the cot of her mother-in-law and there is no eye witness of the occurrence, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri R.K. Roy, J.M. Ist Class, Sheikhpura in Karandey P.S. Case No. 13 of 2014.
