Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The FIR of the occurrence of murder is against unknown. The petitioner was implicated in this case on the basis that the mobile of the petitioner was located near by the place of occurrence of murder.

Submission is that at the time of occurrence, the petitioner was in jail in connection with some other case. Considering the fact that there is no substantial material against the petitioner and the investigation of the case is already complete and the petitioner is in custody since 12.09.2017, let the petitioner, above named, be released on bail

Patna High Court CR. MISC. No.6624 of 2019(3) dt.23-04-2019 2/2 on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S. Tr. No. 161 of 2018 arising out of Derni Police Station Case No. 95 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
