The petitioner seeks bail in Baligaon P.S. Case No. 14/2015, registered for the offences punishable under Sections 376, 511, 504 of the Indian Penal Code.

The informant made allegation that the petitioner entered into her house and made attempt to commit rape with her. It is submitted that the entire allegation is false. The petitioner is the neighbour of the informant. The petitioner had earlier filed Baligaon P.S. Case No. 40/2011 under Section 307 of the Indian Penal Code against the informant and others. The petitioner is a disabled person and he cannot run fast. The petitioner is in jail since 01.06.2015.

Considering the facts aforesaid and the fact that the petitioner is neighbour of the informant, the petitioner above

Patna High Court Cr.Misc. No.39936 of 2015 (2) dt.01-09-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Pandey, Judicial Magistrate 1st Class, Vaishali at Hajipur, in connection with Baligaon P.S. Case No. 14/2015.
