The petitioner seeks bail in a case under Section 379 of the Indian Penal Code.

The case was registered against unknown for theft of Bolero jeep and mobile. The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The only material that has come against the petitioner is that the petitioner used to call on the stolen mobile. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari (East Champaran) in Motihari Town P.S. Case No. 216/2010.
