The petitioner apprehends his arrest in Buxar (M) P.S. case No. 15/2016 under Section 138 of the Bihar Electricity Act, 2003.
The petitioner was found committing theft of electrical energy in his flour mill by running 5 H.P motor (3.73 KW) through connecting Toka from L. T. Line, which caused loss of Rs. 1,70,236/- to the electricity department. Sri Buxi S.R.P. Sinha, the learned senior counsel for the petitioner, submits that petitioner is ready to pay the entire amount in 10 equal installments.

Patna High Court Cr.Misc. No.24530 of 2016 (4) dt.16-08-2016 2/2 Distribution Company Ltd. did not object as the petitioner is ready to deposit the entire amount.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Buxar (M) P.S. Case No. 15 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. If the petitioner fails to pay any installment till the realization of entire amount within ten months, the learned court below shall cancel the bail bonds of the petitioner.
