Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends her arrest for the offences alleged under Section 304/34 of the Indian Penal Code, registered in connection with Abadpur P.S.Case No.38 of 2020. As per allegation, the present petitioner called the brother of the informant, whereupon the accused persons, including the petitioner badly assaulted him. Due to assault, the brother of the informant died.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.16905 of 2021(4) dt.28-03-2022 2/2 that the petitioner is lady and both the parties have compromised the case. He has submitted further that other accused persons have been granted regular bail.

There is specific allegation against the present petitioner that she called the deceased and when he went to the spot the accused persons including the present petitioner assaulted the deceased.

In my view, it is not a fit case for anticipatory bail. The prayer for anticipatory bail on behalf of the petitioner is hereby rejected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
