The petitioner seeks bail in a case registered under Sections 147, 148, 149, 302, 506 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that accused persons including the petitioner armed with three nott, masket, gun and other deadly weapons restrained the father-in-law of the informant and when co-accused Dayanand Panjiyari ordered to kill father-in-law of the informant, co-accused Anil Panjiyara, Nawal Panjiyari, Dilip Panjiyari and Jagadambi Panjiyara fired upon him, due to which he fell down and died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.11.2018. Charge sheet has

Patna High Court CR. MISC. No.7548 of 2019(5) dt.29-04-2019 2/2 been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be a member of the mob. No injury is attributed against the petitioner. The main allegation is against co-accused Anil Panjiyara, Nawal Panjiyari, Dilip Panjiyari and Jagadambi Panjiyara.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur (Fullidumar) P.S. case No.357 of 2016.
