In course of investigation, the petitioner was apprehended and looted mobile was recovered from his conscious possession and, thereafter, the petitioner confessed his guilt leading to recovery of another stolen mobile from possession of co-accused Sanjay Kumar.
The contention on behalf of the petitioner is that the petitioner disclosed before the I.O. that he had purchased the recovered mobile from co-accused, Sanjay Kumar but the I. O. did not mention the aforesaid fact in the statement of petitioner. It is further contended by him that the petitioner does not have any criminal antecedent and is languishing in jail custody since 30-06-

Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Darihat P.S. Case No. 40 of 2015 to the satisfaction of Sri Divesh Kumar, Judicial Magistrate-Ist Class, Dehri-on-Sone, Rohtas.
