The petitioners are languishing in judicial custody since 22.07.2018 in connection with Rail Jehanabad (Taregna) P.S. Case No. 47 of 2018 for the offences alleged under Sections 379, 411 and 34 of the Indian Penal Code.
The prosecution case is lodged by the informant, namely, Md. Mansoor, is that while boarding the train his mobile was stolen and mobile of other passengers were also found to be stolen. Two ladies (petitioners) were caught who were fleeing from the train and from their possession the stolen mobiles were recovered.
It has been submitted by the learned counsel for the petitioners that they are innocent, bear no criminal antecedent
Patna High Court Cr.Misc. No.7745 of 2019(2) dt.11-02-2019 2/2 and have been falsely implicated in the aforesaid case. He submits that charge sheet has already been submitted and the petitioners are languishing in judicial custody since more than six months.
However, the learned Additional Public Prosecutor for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record as well as the period of custody, let the petitioners, above named be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Rail Jehanabad (Taregna) P.S. Case No. 47 of 2018 to the satisfaction of the learned Judicial Magistrate, Railway, Patna. (Nilu Agrawal, J) Shamshad/- U T
