Heard learned counsel for the petitioner and the learned Addl. Public Prosecutor, appearing on behalf of the State. Allegedly, two persons were riding a motorcycle and on seeing the patrolling party they are said to have fled away leaving the motorcycle. From near the motorcycle, police seized 100 litres of Mahua wine. It is also alleged that from a near by place, manufacturing equipments and 100 litres Mahua wine were also recovered.

Learned counsel for the petitioner has submitted that the petitioner has no criminal antecedent and that the petitioner's

Patna High Court Cr.Misc. No.23639 of 2016 (3) dt.14-07-2016 2/2 name has surfaced only on the basis of statement of the local chaukidar. He has also submitted that there is no likelihood of the petitioner fleeing from the course of justice or tampering with the evidence.

Considering the above, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in Chandauti (Chakand) P.S. Case No. 67 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutives occasions, his bail bonds shall be liable to be cancelled.
