2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 395 and 397 of the Indian Penal Code.

3. The case of the prosecution is that seven unknown miscreants had entered in the house of the informant and they had made firing and took away the valuable from his house.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the First Information Report (FIR) was lodged against unknown miscreants. During the course of investigation, name of the petitioner has surfaced only on the basis of the confessional statement of co-accused. Nothing has been recovered from the conscious possession of this petitioner. It is further submitted that save and except the confessional statement of co-accused,

It is contended that similar situated co-accused, namely, Ali Imam Nadaf @ Md. Aliman Bhalhi has been extended the privilege of bail vide order dated 17.12.2025 passed in Cr. Misc. No. 85692 of 2025. Moreover, the petitioner is languishing in judicial custody since 20.06.2025.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jale P.S. Case No. 113 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Darbhanga, subject to the condition that the petitioner shall cooperate in the trial and shall mark his attendance at concerned police station weekly, failing which the learned Magistrate will be at liberty to pass appropriate orders.
