Heard learned counsel for the petitioner and respondents.

Counsel for the petitioner submits that petitioner is to retire in this month itself and his representation is pending before the Director, Secondary Education, as contained in Annexures- 3

Patna High Court CWJC No.2279 of 2018 (2) dt.07-02-2018 2/2 and 4, and as such he submits that the writ application itself may be disposed of with direction to the Director, Secondary Education to examine the representation and on verification of the record, if the Director, Secondary Education finds merit in the claim of the petitioner, then the Director, Secondary Education may pass appropriate order.

In view of the aforesaid prayer, the writ application is disposed of with a direction to the Director, Secondary Education to take final decision on the representation of the petitioner pending before him within a maximum period of two months from the date of receipt/production of a copy of this order. It is made clear that this Court has not expressed any opinion on the merit of the claim of the petitioner. It shall be the responsibility of the Director, Secondary Education to examine the relevant records and after scrutiny of the relevant record, the Director, Secondary Education is required to pass appropriate order with the time as indicated hereinabove.
